Balthrop Trial Ends in Mistrial

AND THE TRIAL FOR A FORMER STEPHENS COUNTY DEPUTY ALSO ENDED IN A MISTRIAL.

BRANDON BALTHROP IS ACCUSED OF ASSAULTING WOMEN WHILE ON THE JOB.
HE'S CHARGED WITH SECOND DEGREE RAPE... KIDNAPPING... AND SEXUAL BATTERY.
PROSECUTORS BELIEVE HE MOLESTED FOUR WOMEN WHILE ON DUTY FROM 2007 TO 2010.

BALTHROP'S DEFENSE ATTORNEY, JIM KEE, SAYS THREE JURORS ON HIS PANEL RECEIVED THE SURVEYS.
KEE SAYS SUCH SURVEYS REPRESENT IMPROPER CONTACT WITH JURORS BY THE D-A'S OFFICE.
D-A HICKS SAYS WHILE THE SURVEYS WERE NOT MEANT TO BE MAILED UNTIL AFTER THE TRIALS, NO LAWS WERE VIOLATED ... AND HE SAYS OUTSIDE OF THOSE MAILINGS, THERE WAS "ABSOLUTELY NO CONTACT" BETWEEN HIS OFFICE AND POTENTIAL JURORS.
    BOTH CASES ARE SET FOR RETRIAL IN APRIL.
