The trial for 49-year-old Garland Allen will now move forward, after it had been put on hold so Allen could be evaluated for mental competency. In the hearing Monday, Allen's attorneys waived his right to a trial by jury.
Authorities say in December, Allen led them to the remains of his ex-wife Tracy in a remote area near the Tom Steed Reservoir. Officials believe Tracy may have been killed in 2001 during an argument in Allen's trailer.
Allen's preliminary hearing is set for 9 am on July 22.
