It looks like it could be another year before a man charged with killing his two young sons goes to trial. It won't be the new Young County District Attorney who
prosecutes him.. Gabriel Armandariz has been in jail for a year and a half on 2 counts of capital murder. He's accused of killing his 6 month old and 2 year old sons one
week before a custody hearing was set in court. Trial has now been set for September 9th of next year, but could be moved earlier depending on a conflict with another
trial. It will be the state attorney general's office prosecuting the case. Young county district attorney Dee Peavy says the former D.A. Brenda Gray, who lost the
primary election and resigned before her term expired, requested the attorney general take over the case. Peavy says she was not involved or consulted about the change. 6-
Month old Luke, and 2 year old Gatlin were reported missing in April 2011 after family members say Armandariz sent them pictures of the boys from his cell phone.
Police say in the pictures, one of the boys was hanging by his neck. Armandariz was declared competent to stand trial earlier this month.
