The Sanger man's murder conviction was overturned by the Texas 2nd Court of Appeals, for lack of physical evidence, including a body or DNA.
Stobaugh was released from custody on January 23rd.
Kathy stobaugh vanished in late December, 2004, on the eve of their divorce, as she was preparing for another school semester in Nocona.
Her car was found at Charles Stobaugh's farm.
Stobaugh's $25,000 bond came with conditions, including having to wear a gps monitor.
Another bond hearing to set other conditions is scheduled for February 13th in the Denton court he was convicted.
