Now the Young County attorney is in a similar situation. County commissioners met in executive session Thursday to discuss the situation, but did not announce any decision.
The problem arose when Young County Attorney Dayne Miller filed to run for the hospital board.
Under article 16 of the state constitution, when certain elected officials including county attorneys announce or become a candidate for another office, it constitutes automatic resignation from the other office.
County Judge John Bullock says when Miller learned of that, he tried to withdraw from the election, but it was too late and his name will be on the May ballot.
Right now, Miller continues to fill the vacant office of county attorney, and can do so until a successor is elected in November to fill the unexpired term.
Bullock says each party can nominate a candidate in that election. He says if elected to the hospital board in May, Miller could tender his decision not to serve and possibly be a candidate in November.
He says county commissioners will take up the issue again in their next meeting.
