James May was set to have a hearing on the revocation of his probation today.
That hearing has been pushed back two weeks.
He received five years deferred adjudication for taking Miss Silver Buckle in front of Tangles Salon and cutting the statue into pieces.
Another man also received deferred adjudication.
Both men were also ordered to pay restitution.
According to documents filed by the D.A's office, May tested positive for use of drugs and alcohol, which violates his probation.
The D.A. also alleges May failed to report to his community supervision officer on several occasions, failed to maintain a job, failed to follow through with an alcohol and drug program he was referred to, and is delinquent on several fees.
He's due back in court January 17.
