The man accused of murdering a Wichita Falls mother of three declined to show up for another of his court hearings today and his attorney is preparing to ask for the trial to be moved out of Wichita County because of all the publicity on the case.
Jerry Joe Garza was not in the courtroom this afternoon and has filed motions indicating he does not want to attend future court proceedings.
In past hearings, Garza had refused to leave his jail cell.
And when Garza did attend other proceedings he got contempt of court citations for profanity laced outbursts, and at another hearing he lunged at our photographer.
Garza's third appointed court lawyer, Michael Payne, says the media coverage is why he plans to file for a change of venue.
Payne says he is not yet ready to go to trial, as he is relatively new to the case and says he still needs to meet with Garza.
But the court is preparing for the official motion from the defense to move the trial somewhere else.
Garza is accused of the February 2011 murder of his ex-girlfriend Monica Partida, she was found dead in her home on Britain.
Authorities say Garza took a bus from Dallas and then a taxi to and from the murder scene.
He is jailed on $3.5 million bond.
