Man Receives Probation for Kicking 4-Year-Old


A Wichita Falls man arrested for kicking a 4-year old boy who had to be treated at Cook Children's Hospital in Fort Worth accepts a plea agreement for probation.

Derek Mauldin pleaded guilty this morning in 30th District Court. He was sentenced to 10 years, which was suspended for 5 years probation and was also fined one thousand dollars.

He said his parents now have custody of his children and his attorney says Mauldin has completed an anger management course. Mauldin requested permission to travel outside the county while on probation because he is a storm spotter.

Police say the boy's mother told them her son suffered internal injuries after Mauldin accidentally kicked him. Mauldin's side of the story was that the boy threw a bottle, hitting him in the eye and it caused him to have a reflex kick, which he claimed wasn't hard.

But doctors at Cook Children's Medical Center in Fort Worth, where the boy was taken for emergency surgery, say the injury was similar to those seen in high-speed traffic accidents and listed it as physical abuse.

A six-year-old boy who witnessed the incident demonstrated to police how Mauldin kicked the four-year-old by lifting his knee and stomping down on the boy's stomach.
