Punishment Arguments Conclude in Nash Trial

A 23-year-old man found guilty yesterday of the June 2012 aggravated robbery of a local convenience store will have to wait another week to learn his punishment.

The judge in this case asked for a pre-sentence investigation to be done on the defendant, which is why punishment wasn't decided today.

The jury's verdict means Nash was one of the three men wearing masks and gloves police say were armed when they held up the convenience store employee.

Officers say they got away with a little more than $100 and a couple DVD's.

During punishment arguments this morning, lead prosecutor John Gillespie called a Wichita Falls police officer to the stand.

That officer testified he responded to a disturbance at Texas Showgirls in March of last year.

He says that's where he found Nash and his brother and Nash had a gun magazine in his pocket then a pistol fell from his pants leg.

He also says Nash was wearing a bullet proof vest.

Head Public Defender Jim Rasmussen called one witness: Nash's uncle.

He testified that Nash didn't have the best home life growing up and maybe that's had an influence on some of the decisions he's made.

He says Nash can learn from his mistakes and become a productive member of society.

Gillespie says Nash has already had a second chance.

According to court records filed by the prosecution, in November 2005 when Nash was 15-years-old, he was sentenced to serve time at the Texas Youth Commission for three counts of burglary of a habitation and one count of aggravated robbery.

During that robbery, Nash and another man robbed a car wash and laundromat on 9th St.

Nash admittedly held a knife to a 10-year-old girl's throat and threatened to kill her if she didn't tell him where the safe was located.

Defense attorneys filed an application for probation as punishment, but documents filed by the prosecution state because of Nash's record as a juvenile, he faces at least 15 years but up to 99 year or life in prison.
