State and Local Texting and Driving Laws Collide


During the 85th legislative session, Texas became one of the last states to adopt a statewide texting while driving ban.

In the meantime, the Wichita Falls city ordinance which prohibits texting and talking on a cell phone while driving is a little tougher. But that could change if Governor Abbott has his way.

Does it put us in a weird predicament? Sure. Is it something I like? No. But we find ourselves these days being impacted by the state," Mayor Stephen Santellana said.

While the new law, if passed, would override the current city ordinance, Wichita Falls Sgt. Harold McClure says both the city ordinance and the statewide bill still zero in on safety.

"So the whole point is to re-emphasize the importance of a driver being focused on the task at hand which is driving. The phone call can wait. The text can wait," McClure said.

For some Wichita Falls residents, the statewide bill would be a benefit in the city.

"I think it's going to be a little more effective just because there are a lot of people texting and driving. I try not to text and drive, I'm not going to lie- I've done it a few times.

Others think both bills should have tighter restrictions overall.

"It's illegal to use your phone on the Sheppard Airforce base. It should be that was everywhere just because distraction can kill people."

Since the ordinance was put in place in March, authorities have given out a total of 102 citations.

The Texas Legislature's special session will begin in mid-July in Austin.
