Sheriff Duke and Wichita County are included because the woman says her false arrest warrant was issued in Wichita County. She says that arrest resulted in corrections officers assaulting her in a Chattanooga detention center.
A jury was seated in the federal district court in Chattanooga Monday and opening statements were made Tuesday according to a court clerk.
It's scheduled to resume at 12:30 Wednesday afternoon.
The plaintiff, Donna Johnson, was arrested in 2011 on a theft warrant issued here after Duke says he was unable to obtain photos she was supposed to take of his staff. Those charges were later dismissed, and she then filed a federal suit. She is seeking damages of at least a half million dollars.
The county is being represented by an attorney in the district attorney's office and by a private attorney in Tennessee.
