Whistleblower Lawsuit Filed by Former Young Co. Employee

A whistleblower lawsuit alleges a former Young County employee was fired for reporting that a county commissioner used work equipment for private reasons.

Philip Swan filed the suit in 30th District against Young County seeking monetary relief of more than $100,000.

Swan had been working as a road maintenance foreman for nearly six years.

The suit claims that in February of last year, he reported to the Texas Rangers that Commissioner Stacey Rogers had misused county equipment.

According to the suit, Rogers also engaged in "obstruction of the law" by directing a witness' testimony by telling another employee to give a false statement to authorities.

Swan even claims that he got no call back when he tried to tell the Young County District Attorney's office about the matter.

In the suit, Swan says he was harassed by Rogers in order to force him to quit.

He goes on to say that Rogers even admitted to Swan's wife that he was trying to get him to resign.

Swan was fired on January 3rd..

The lawsuit points to the Texas government code that states that it is illegal for a state or local government entity to suspend or terminate the employment of an employee who in good faith reports a violation of the law.
