Woman Sues Nocona and Deputy in the Death of Her Husband

The widow of an off-duty Montague County Sheriff's Deputy shot and killed by a Nocona police officer following a disturbance two years ago has filed a wrongful federal death lawsuit in US District Court, in Wichita Falls.

The lawsuit names the City of Nocona and the responding officer Robert Gillock as the defendants.

According to the suit, on Feb. 15 2015 Gillock was responding to a disturbance call that night  at the Nocona home of 41-year-old deputy Larry Hostetter.

Hostetter was shot inside the home and pronounced dead shortly after and at the time of the shooting authorities didn't tell us what prompted the officer to fire his weapon. The lawsuit states that shortly after  Gillock got to the Hostetter home, he turned off his microphone.

The suit also claims that Gillock asked Hostetter's wife, Jennifer, to leave the home, which she did. It states Hostetter was shot between when his wife left and before other deputies arrived.

Hostetter's wife says in the suit that her husband posed no threat to Gillock so deadly force wasn't needed. After the shooting, Jennifer Hosteter says she noticed that a security camera  inside the home,  which was always pointed at the door,  was pointing down toward the floor.

And  she also says she gave Montague County investigators the password to look at the camera footage, but when she went to her camera, she said all the video was removed.

Authorities say Hostetter joined the sheriff's office in 2013,  and had been in law enforcement several years.
