A former Burkburnett man who was just months from the end of his 10 year's probation in connection with a fatal chase, is back in jail.
A former Burkburnett man who was just months from the end of his 10 year's probation in connection with a fatal chase, is back in jail.

Twenty-eight year old Dustin Wade Marlar is jailed for new theft charges and for revocation of his bonds and probation.

He pleaded guilty to evading arrest and detention involving a death in 2004.

That case began when troopers tried to pull him over north of Bellevue on 287.

They say Marlar fled at speeds up to 100 miles an hour with his 11-year-old step-sister Kelsey Morgan in the car.

Marlar lost control when he drove onto a gravel road and slammed into a sign. Kelsey died of massive head injuries.

After the accident, relatives and friends heard rumors the trooper chasing Marlar had rammed him, causing the accident.

Kelsey's grandather was then arrested for making a death threat on the trooper because he claimed his granddaughter would still be alive if he had not rammed the car.

But dash cam video KFDX obtained appears to show the trooper maintained a safe distance behind Marlar until Marlar hit the gravel and and crashed.

The victim's grandfather, Billy Ray Morgan, admitted guilt to making the threat and received 10 years probation.

Marlar was arrested again last November after a man says he stole his girlfriend's wallet at Kohl's.

Police say the couple began chasing Marlar's SUV down Kemp, at one point running into it when Marlar slammed on the brakes.

A nearby law officer then pulled Marlar over. He was charged with DWI, accident involving damage, and presenting a fake ID.

His most recent theft charge involves the alleged theft of computer game systems which he allegedly stole from a friend and sold at Hastings.
