Doctor Oscar Morales is free on a $100,000 bond, on a charge of assault with a dangerous weapon.

According to police, Morales was bringing his children back to his ex-wife's home and her boyfriend, was in the garage.

The affidavit states a boy was carrying a bag with a stuffed animal in it, and the boyfriend told him to give it back to his dad, sparking the argument.

Police say morale's ex-wife got between the two men, but Morales reached around her and fired one shot into the lower part of the other man's body.

His injury is not believed to be life- threatening.

Police say the shooting was also witnessed by Morales' 11 year-old daughter from a window.
