Man Pleads to Lesser Charge in Pizza Hut Attempted Robbery

Matthew Gregory pleaded guilty to theft from person.
A man charged with robbing a pizza restaurant with a toy ray gun will not spend time behind bars.

Matthew Wayne Gregory was originally charged with robbery, but today in 89th District Court, he pleaded guilty to the lesser offense of theft from person.

He's sentenced to three years deferred adjudication and ordered to pay a $750 fine.

Police say in November 2011, Gregory pulled up to the drive-through window at the Pizza Hut on 5th St. and ordered a pizza.

He got out of the vehicle, crawled partially into the window, trying to grab money from inside.

Arrest records state the employee noticed he had a toy ray gun, pushed the man out the window, locked it and called police.
