UPDATE: Tuesday, March 9, 2021, 10:00 a.m.
The arrest affidavit for Christopher Payne, the suspect in the murder of Bobby Joe Fernandez, reveal the events leading up to the fatal shooting Saturday night, March 6.
According to the affidavit, when officers arrived on the scene at Shop & Go on 32nd Street, Fernandez was already deceased.
Officers watched surveillance footage from Shop & Go that showed Fernandez sitting at a gaming machine inside the store.
The affidavit said officers saw a white male in a grey hoodie, blue jeans, red bandana over his nose and mouth, baseball hat and gloves approach Fernandez.
According to the affidavit, the subject can be heard saying “you got my money” to Fernandez on another security camera that captures audio.
The affidavit said after some inaudible dialogue between the subject and Fernandez, the subject can be heard saying “I’ll wait for you outside.”
Security footage later shows Fernandez leave the machine and head outside.
According to the affidavit, just a couple seconds after Fernandez leaves, what is believed to be a single gunshot is heard.
A third security camera shows the same subject walking away from the store quickly after the apparent gunshot.
The affidavit said a witness on the scene told police a person matching the description of the subject walked up to Fernandez and shot him at point blank range.
The witness told police when she called 911, Fernandez’ girlfriend was yelling, “Bird shot him”, and the subject left the scene in a silver pickup truck.
Another witness told police “Bird” refers to Christopher Payne, who the witness said walked up to Fernandez and shot him after an argument about money.
The affidavit said officers found the suspect vehicle parked in the 2400 block of Avenue L and while searching the area found discarded clothes matching those worn by Payne the night of the shooting.
