The Wichita Falls Five Guys Burgers and Fries location on Midwestern was shut down by state officials today for nonpayment of sales tax receipts.

Chris Bryan of the state comptrollers office says the company owes just under $31,000 in unpaid sales taxes.

The comptroller’s office, accompanied by two state troopers, served a limited seizure of property at the store during the noon hour.

That essentially means items may have been seized against the amount owed.  The sales tax permit was also suspended, but not revoked, meaning the business can continue to operate.

He says it’s the owners option whether and when to reopen, however it appears the restaurant has been closed since the officials arrived.

He says the state works with businesses and gives advance warnings about the delinquent amount in hopes it will be paid. Only when no effort to repay or make a payment plan is made does Bryan say seizures  are made.

Bryan says there are also liens filed  against the business in Wichita and Travis counties.

Property could have been seized today but Bryan could not reveal if and what it was.
If no effort to make payments is made, Bryan says  the permit can be revoked and a full seizure of assets can happen. He said customers have paid the taxes and it is owed to the state.

We have made numerous calls to the restaurant tonight and got no answer.
