WICHITA FALLS (KFDX/KJTL) - The initial appeal for a new trial by Kody Lott's attorneys has been denied and he is now awaiting transfer to prison to begin serving his sentences.
In September, Lott was found guilty by a jury in Tarrant County and the jury gave him life in prison for the murder of McNiel student, Lauran Landavazo and 20-years for the shooting of her friend, Makayla Smith.
Attorneys are appealing on the basis that the verdict and sentence were contrary to the law and evidence, which was insufficient to justify the verdict and sentence.
The defense maintains the verdicts were obtained using inadmissible evidence.
Lott's attorneys tried to have key evidence, like the gun Lott used and the vehicle he was in, ruled inadmissible saying they were seized without due process.
They also maintain his confession should not be admissible either.
Defense attorneys failed in their effort to get a verdict of not guilty by reason of insanity.
Now that the trial court has denied a new trial, the public defender's office has filed notice of appeal to the state of appeals courts.
