Two years after a father of two was shot and killed in Clay County, a Henrietta man is now indicted for his death and the woman first charged with murder is cleared.

Donny Davis, 23, is charged with manslaughter in connection with the death of Gregory Allen Gray, Jr., 30.

David was arrested back in September and is jailed on more than $250,000 in bonds.

Macey Alexandra Choate was originally charged with murder five months after Gray’s death.

However, a Clay County grand jury has decided not to indict her, and the district attorney has dismissed the charge.

Choate’s attorney, Roger Williams of Nocona, said Choate cooperated fully with authorities in the investigation and answered all their questions.

In May 2016, Clay County authorities said Choate told county deputies she found Gray, who she was dating at the time, unresponsive in their home and took him to the hospital in her car.

According to her arrest affidavit, Choate told medical personnel conflicting stories about what happened.

She was charged 5 months later but now all charges are dismissed.
