Wichita Falls man sentenced to life for sexual assault of a child

A Wichita Falls man who assaulted a young boy at a park restroom will spend the rest of his life in prison.

On Friday morning a jury found Harvey James Neil guilty of aggravated sexual assault of a child in 89th District Court, he was sentenced to life in prison.

After sentencing, the prosecution read a short statement from the victim and the victim’s family.

In the statement, the family asked that Neil think about the child he hurt, and the victim said, “I hope you rot in a cell.”

Neil was arrested in May 2016 after police said he forced a young boy to have oral sex inside of a restroom at Spudder Park on Central Freeway East.

According to investigators, the boy said he met Neil when he went to the park for an after-school program. The victim said Neil first asked him to wrestle him in the sandbox, then while they were playing Neil started biting and licking his ear, and then felt in the boy’s pants. After that, he told authorities that Neil took him into the park restroom where he was told to perform oral sex.

The young boy said when Neil let him go, he ran to the first adult he saw.

Wichita County Assistant District Attorney Starla Jones said a conviction and punishment like this sends a message to the community.

“I think it tells the community that this kind of thing isn’t going to be tolerated in Wichita County,” Jones said. “Our jurors are very strong and want to see justice down, especially for the children in our community.” 

Neil’s reaction to his sentence was minimal, but his friends and family were visibly upset in the courtroom.

Neil’s criminal record includes 18 misdemeanors and three felonies. The charges ranged from invalid license to possession and delivery of a controlled substance to organized criminal activity.
