Wichita Falls Considering Ending Contract with Company Due to Believed Contract Breach

By the end of February, the first phase of the Wichita Falls Hike and Bike trail was supposed to be finished, but it is just over 50 percent complete.
All four phases of the project would create a 26 mile path through the community.
On Tuesday, the Wichita Falls City Council could approve a resolution that finds the company responsible for the first phase of the trial in breach of contract. This will allow the city manager to end the agreement. 
The first phase stretches from Seymour Highway to Lucy Park and Mega Prime Contractors was awarded the bid for around $1.3 million. 
“It’s always frustrating when something like this happens,” Mayor Glenn Barham said. “But knowing the times, construction companies get in trouble on occasion and this one did and was not able to live up to the project. We did check all of their backgrounds before.” 
The staff said they believe they are in breach of contract for not completing the work in the contract period, the contractor saying he lacks the funds and the company failing to make repairs.
